Community Group Visits terms & conditions

The following terms and conditions (“Terms”) shall apply to all Partners who participate in any Monterey Bay Aquarium community access program (“Program”) and shall form a legal agreement between the Partner and Monterey Bay Aquarium (“the Aquarium”). 

The Aquarium reserves the right to amend these Terms from time to time without prior notice to Partners. Partner confirms that it has read and agrees to be bound by these Terms by participating in any Program.

Compliance with the Aquarium's terms and conditions

Partners confirm they have read and agree to comply with the Aquarium’s terms and conditions, behavior guidelines, and free group visit program policies listed below, at all times while at or on Monterey Bay Aquarium property:

Publicity

Partners shall not advertise any visits to the Aquarium provided to them pursuant to any Program on any public forum, including on any social media or social networking platform. For the avoidance of doubt, this prohibition on public disclosure of visits provided pursuant to a Program includes statements, photos, and comments.

Prohibition on sale of tickets or charging guests

Partners shall not sell or resell tickets or charge guests for tickets to Program events. In the event that a Partner sells or resells tickets issued to it pursuant to a Program or in the event Partners charges guests a monetary fee or requires contribution of a benefit to Partner in exchange for a ticket issued pursuant to a Program, the Aquarium may choose to cancel the event without prior notice to Partner and/or revoke Partner’s participation in any Program.

Intellectual property

Partners agree and acknowledge that all of the Aquarium's logos, trademarks, service marks, marketing materials, and programs (“Monterey Bay Aquarium Intellectual Property”) are the sole property of the Aquarium.

Partners agree that they will not use Monterey Bay Aquarium Intellectual Property in any context, including without limitation in print materials or communications, without obtaining the Aquarium's prior, express written permission to do so.

Cancellation of reservations

The Aquarium reserves the right to cancel reservations for any Program events at any time, at the Aquarium's sole discretion. This includes but is not limited to violations of Program policies such as:

  • Reservations exceeding 10 visits per calendar year;
  • Reservations of fewer than the minimum group size of 15 people or greater than the maximum group size of 120;
  • Groups that do not include at least one staff member from the partner organization;
  • Groups that do not consist of the audience Partner claimed to serve on its application;
  • Groups that do not check in together at (or around) the designated entry time;
  • If the Aquarium is unable to communicate with the primary point of contact for the group or in the event the primary point of contact for the group fails to promptly respond to the Aquarium's attempts to communicate for a period of time longer than five (5) days.

Rejection or revocation of partnership

The Aquarium reserves the right to reject applications to partner in any Program at any time, at the Aquarium's sole discretion, without prior notice to applicant.

The Aquarium reserves the right to revoke participation of any Partner in any Program and any related benefits at any time, at the Aquarium's sole discretion, without prior notice to Partner.
